ProWriter Plus software is purchased exclusively of the My Covered Calls data service. ProWriter Basic is supplied free, usually with a subscription to the My Covered Calls data service. ProWriter Basic is exclusive of the My Covered Calls data service. ProWriter will not operate without access to the data service. The contract to licence ProWriter and the contract to subscribe to the data service are independent and exclusive. The purchase of ProWriter Plus does not entitle the buyer to access the data service. A subscription to the data service is required to support the operation of ProWriter. If you subscribe to the My Covered Calls data service and download a copy of ProWriter Basic and/or purchase a ProWriter Plus licence; and subsequently default, unsubscribe, or no longer have access to the data service; then ProWriter will not operate as described.
If you keep the Software, You are agreeing to the terms of this Agreement. Use of the Software is subject to this agreement. If you do not agree to the terms of this Agreement, at the time of purchase, then return the Software and accompanying material provided to MY COVERED CALLS Pty Ltd or the location where you obtained it for a refund.
MY COVERED CALLS Pty Ltd grants you a non-exclusive right to use this copy of the Software and accompanying materials according to the following:
You May
- use and install the Software on one (1) computer;
- make one (1) copy of the Software for backup purposes; and
- transfer the Software from one computer to another so long as the Software is neither used on nor copied onto more than one computer at a time
You May Not
- modify, reverse engineer, or copy (except for the backup copy) the Software or accompanying materials; or
- rent or transfer the title of the Software
This license is not a sale. Title and copyrights to the Software and accompanying materials remains with MY COVERED CALLS Pty Ltd and its licensors. Any breach terminates this Agreement. LIMITED WARRANTY, DISCLAIMER, AND LIMIT OF LIABILITY
In the event of data becoming unavailable for a period of no less than fourteen (14) working days within the first three (3) months of purchase of the ProWriter Plus programme, the user is entitled to a fifty percent (50%) refund. MY COVERED CALLS Pty Ltd and its licensors do not warrant your data,that the Software will meet your requirements, or that the operation will be uninterrupted or error free.
THE WARRANTY ABOVE IS IN LIEU OF ALL OTHERS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES HAVE LAWS THAT MAY RESTRICT OR PROHIBIT THE LIMITATIONS SET FORTH ABOVE AND YOUR RIGHTS UNDER LAW MAY VARY ACCORDING TO THE LAWS OF YOUR STATE.
MY COVERED CALLS Pty Ltd and its licensors shall not be liable for any incidental or consequential damages, including loss of data, lost profits, cost of cover, or other special or indirect damages. Your rights under law may vary.
GOVERNING LAW AND JURISDICTION
The law of Queensland, Australia governs this agreement.
